These Terms of Service (the "Terms") are a binding agreement between you and A5 Software LLC ("A5", "we", "us", or "our"), which operates Hexis. They govern the Hexis software, loader, modules, scripts, marketplace, website, dashboard, Discord server, hosted services, and every other product or service we provide (together, the "Services"). By creating an account, purchasing, downloading, installing, or using any part of the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
SECTION 17 CONTAINS A BINDING ARBITRATION AGREEMENT AND A CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES ARE RESOLVED. PLEASE READ IT CAREFULLY.
Hexis is an automation framework for Minecraft, intended for learning automation and scripting, single-player worlds, development and testing, and servers where you have permission to use it. Hexis is not designed, intended, or marketed for violating any third-party server's rules or terms of service. All scripts included with or offered through Hexis are sample implementations. You alone decide whether, where, and how to run them.
YOU ACKNOWLEDGE AND AGREE THAT:
You are solely and fully responsible, and legally liable, for all of your acts and omissions, and for every act and omission of anyone who uses your account, license, devices, or linked accounts, whether or not you authorized it. This includes every script you run, every action your Minecraft accounts take while Hexis is running, all content you upload or share, and all of your dealings with game servers, other players, and third parties.
A5 does not control, supervise, or direct how you use the Services and is not responsible for your conduct or its results. You are responsible for knowing and following the rules of every server you join and every law that applies to you.
Subject to these Terms and payment of any applicable fees, A5 grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Services for your own non-commercial use. This license is:
The Services are licensed, not sold. "Lifetime" means for as long as A5 makes the Services available and your license has not been revoked or terminated. It does not mean your lifetime or ours. A5 and its licensors keep all rights, title, and interest in the Services, including all intellectual property. No rights are granted except those expressly stated here.
Pro is an optional monthly add-on to a Lifetime licence. It is billed in advance and renews automatically each month at the price shown at checkout until you cancel.
You agree not to, and not to help or allow anyone else to:
You keep ownership of scripts, configurations, and other content you upload or share through the Services ("Your Content"). You grant A5 a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable license to host, store, copy, modify, display, and distribute Your Content as needed to operate, improve, secure, and promote the Services. You confirm that you have every right needed to grant this license. We may remove Your Content at any time for any reason. Any feedback or suggestions you give us may be used by A5 without restriction or compensation.
A5 MAY SUSPEND, LIMIT, REVOKE, OR TERMINATE YOUR LICENSE, ACCOUNT, OR ACCESS TO ANY PART OF THE SERVICES AT ANY TIME, FOR ANY REASON OR NO REASON, WITH OR WITHOUT NOTICE, AND IN OUR SOLE DISCRETION.
Reasons may include, but are not limited to, a suspected violation of these Terms, license sharing, fraud, chargebacks, abuse of staff or community members, risk to the Services or other users, legal or regulatory requirements, or a business decision to change or discontinue the Services. We are not required to explain our decision or give you a chance to cure it.
When your license or account ends, your right to use the Services ends immediately. You must stop using and delete every copy of the software. Unless applicable law requires otherwise, no refund, credit, or compensation is owed for any revocation or termination, including of a Lifetime license or the remainder of a paid Pro period. We may also modify, suspend, or discontinue any feature or the Services as a whole at any time without liability to you. You may stop using the Services at any time.
To enforce these Terms and protect the Services, we may monitor use of the Services, verify licenses, watermark downloads, and collect the technical and usage data described in our Privacy Policy. We may investigate suspected violations and cooperate with law enforcement, platform operators, and payment providers.
Prices are shown at checkout and may change at any time for future purchases. Payments are processed by Stripe. You authorize us and Stripe to charge your payment method for all fees you incur, including Pro renewals. You are responsible for any applicable taxes.
Due to the digital nature of the Services, all sales are final. Refunds may be granted at our sole discretion in cases of:
Refunds will NOT be granted for account bans, dissatisfaction with features, violation of these Terms, or revocation or termination under Section 8, except where applicable law requires it.
The Services interact with products and services we do not control, including Minecraft, game servers such as Hypixel, Discord, Stripe, and AI providers. Your use of them is governed by their own terms, and A5 is not responsible for their availability, content, actions, or decisions, including any decision to ban or penalize you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. A5 DISCLAIMS ALL WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, UNDETECTED, OR FREE OF HARMFUL COMPONENTS, OR THAT THEY WILL MEET YOUR REQUIREMENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL A5 OR ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, GAME ACCOUNTS, PROGRESS, ITEMS, OR VIRTUAL CURRENCY, OR FOR ANY ACCOUNT BAN, SUSPENSION, OR PENALTY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID A5 IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR FIFTY US DOLLARS (US$50).
These limits apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. In that case our liability is limited to the smallest amount the law allows.
You agree to indemnify, defend, and hold harmless A5 and its owners, members, managers, employees, contractors, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
We may take control of the defense of any matter at your expense, and you will cooperate with us. You may not settle any matter that affects A5 without our written consent.
To the extent permitted by law, any claim arising out of or related to the Services or these Terms must be brought within one (1) year after it arises, or it is permanently barred.
Informal resolution. Before starting any formal proceeding, you agree to contact us through our Discord server and try to resolve the dispute informally for at least 30 days.
Binding arbitration. Except for claims that qualify for small claims court and claims seeking injunctive relief for misuse of intellectual property, any dispute arising out of or related to the Services or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs this section. The arbitrator decides all questions of arbitrability except the scope and enforceability of the class action waiver, which a court decides.
YOU AND A5 EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR ARBITRATION. CLAIMS MAY BE BROUGHT ONLY ON AN INDIVIDUAL BASIS.
Opt out. You may opt out of this arbitration agreement by messaging us through our Discord server within 30 days after you first accept these Terms, stating your name, account email, and that you opt out of arbitration. If the class action waiver is found unenforceable for a claim, that claim must proceed in court and not in arbitration.
These Terms are governed by the laws of the State of Oregon and applicable United States federal law, without regard to conflict of law principles. For any matter not subject to arbitration, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Oregon.
We may modify these Terms at any time. Changes are posted on this page with an updated "Last Updated" date and take effect when posted, unless we say otherwise. Your continued use of the Services after changes are posted means you accept them. If you do not agree, stop using the Services.
Hexis is not affiliated with, endorsed by, or associated with Mojang Studios, Microsoft Corporation, or Hypixel Inc. Minecraft is a trademark of Mojang Studios.
BY PURCHASING, DOWNLOADING, OR USING HEXIS, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
